Welcome to Kerarose (“Kerarose,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to and use of kerarose.com (the “Site”) and any purchases, subscriptions, or services offered through the Site.

By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

1. ACCEPTANCE OF TERMS

By accessing or using the Site, you represent that you are at least 18 years old (or the age of majority in your jurisdiction) and have the legal capacity to enter into these Terms.

If you are using the Site on behalf of a business or other entity, you represent that you have authority to bind that entity to these Terms.

2. CHANGES TO THESE TERMS

We reserve the right to update or modify these Terms at any time. Changes will be effective immediately upon posting to the Site, and the “Last Updated” date will be revised accordingly. Your continued use of the Site constitutes acceptance of the updated Terms.

3. USE OF THE SITE

You agree to use the Site only for lawful purposes and in compliance with all applicable laws and regulations. You may not:

  • Use the Site in any way that could disable, damage, or impair its functionality

  • Attempt to gain unauthorized access to any systems or data

  • Interfere with another user’s access to the Site

  • Use the Site for fraudulent, deceptive, or misleading purposes

We reserve the right to restrict or terminate access for violations of these Terms.

4. PRODUCTS & AVAILABILITY

Kerarose offers hair care and beauty products for personal use only. All product descriptions, pricing, and availability are subject to change at any time without notice.

We reserve the right to limit quantities, discontinue products, or refuse any order at our discretion.

5. PRICING & PAYMENTS

All prices are listed in U.S. Dollars unless otherwise stated. Taxes, shipping, and handling fees may apply and will be disclosed at checkout.

By submitting payment information, you authorize Kerarose and its payment processors to charge the applicable amount to your selected payment method. We reserve the right to cancel or refuse orders suspected of fraud or unauthorized activity.

6. SUBSCRIPTIONS & AUTO-RENEWAL TERMS

Certain Kerarose products may be offered on a subscription basis.

By enrolling in a subscription, you authorize recurring charges to your selected payment method at the frequency disclosed at checkout (e.g., monthly or quarterly), including applicable taxes and shipping.

Your subscription will automatically renew at the end of each billing period unless cancelled by you.

Subscription orders are billed automatically according to the selected frequency.

Once a subscription order has processed or shipped, it is not eligible for cancellation or refund.

You may manage or cancel your subscription at any time by:

Subscription changes or cancellations must be made before the next billing date to avoid charges for the upcoming cycle.

7. SHIPPING & RETURNS

Shipping timelines and return eligibility are outlined in our separate Shipping Policy and Return & Refund Policy, which are incorporated into these Terms by reference.

Kerarose is not responsible for delays caused by carriers, customs, or factors beyond our control.

8. INTELLECTUAL PROPERTY

All content on the Site — including text, images, graphics, logos, designs, product names, and software — is the property of Kerarose or its licensors and is protected by applicable intellectual property laws.

You may not copy, reproduce, distribute, modify, or exploit any content without prior written consent.

9. DISCLAIMER OF WARRANTIES

The Site and all products and services are provided “as is” and “as available.”
Kerarose makes no warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.

Individual results may vary. We do not guarantee specific outcomes from product use.

10. LIMITATION OF LIABILITY

To the fullest extent permitted by law, Kerarose shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or products.

Our total liability shall not exceed the amount paid by you for the product or service giving rise to the claim.

11. INDEMNIFICATION

You agree to indemnify and hold harmless Kerarose, its officers, employees, and affiliates from any claims, damages, losses, or expenses arising from your breach of these Terms or misuse of the Site.

12. THIRD-PARTY LINKS

The Site may contain links to third-party websites. Kerarose is not responsible for the content, policies, or practices of third-party sites. Accessing such links is at your own risk.

13. TERMINATION

We reserve the right to suspend or terminate access to the Site at any time, with or without notice, for violations of these Terms or suspected fraudulent activity.

14. GOVERNING LAW

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to conflict-of-law principles.

15. MOBILE TERMS OF SERVICE

The kerarose mobile message service (the "Service") is operated by Kerarose (“kerarose”, “we”, or “us”). Your use of the Service constitutes your agreement to these terms and conditions (“Mobile Terms”). We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time and your continued use of the Service following the effective date of any such changes shall constitute your acceptance of such changes.

By consenting to kerarose’s SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of kerarose through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialing system or other technology. Promotional messages may include promotions, specials, and other marketing offers (e.g., cart reminders).

You understand that you do not have to sign up for this program in order to make any purchases, and your consent is not a condition of any purchase with kerarose. Your participation in this program is completely voluntary.

We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message frequency varies. Message and data rates may apply. Check your mobile plan and contact your wireless provider for details. You are solely responsible for all charges related to SMS/text messages, including charges from your wireless provider.

You may opt-out of the Service at any time. Text the single keyword command STOP to +18444151423 or click the unsubscribe link (where available) in any text message to cancel. You'll receive a one-time opt-out confirmation text message. No further messages will be sent to your mobile device, unless initiated by you. If you have subscribed to other kerarose mobile message programs and wish to cancel, except where applicable law requires otherwise, you will need to opt out separately from those programs by following the instructions provided in their respective mobile terms.

We may change any short code or telephone number we use to operate the Service at any time and will notify you of these changes. You acknowledge that any messages, including any STOP or HELP requests, you send to a short code or telephone number we have changed may not be received and we will not be responsible for honoring requests made in such messages.

The wireless carriers supported by the Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. If you get a new mobile number, you will need to sign up for the program with your new number.

To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Service, any errors in such information, and/or any action you may or may not take in reliance on the information or Service.

16. SEVERABILITY

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

17. ENTIRE AGREEMENT

These Terms, together with our Privacy Policy, Return & Refund Policy, and any other posted policies, constitute the entire agreement between you and Kerarose regarding use of the Site.
